Cientos de miles de usuarios que pagaban por tener internet ilimitado u otros planes en sus celulares empezaron a recibir en las últimas semanas el siguiente mensaje: “Ya alcanzaste tus MB disponibles y se reducirá tu velocidad de navegación. Volvé a tener más velocidad por otros 15MB por $3,30”. La empresa Movistar había decidido cambiar sus planes sin cumplir con las notificaciones ni los plazos ordenados por la ley.
Pero la compañía podría ser obligada a dar marcha atrás con la medida. Este miércoles, la Secretaría de Comunicaciones de la Nación confirmó que la firma fue imputada por haber incumplido los requisitos que establece la ley para poder cambiar un contrato de servicio.
“De comprobarse irregularidades en la comunicación de los cambios, que afectan a 1.700.000 usuarios, se instará a la empresa para que retrotraiga las condiciones a la situación previa y se aplicarán las multas correspondientes“, confirmó la oficina que conduce Norberto Berner a través de un comunicado.
Movistar tiene tiempo hasta este viernes para presentar su descargo. Luego, el gobierno nacional quedará en condiciones de tomar medidas contra la empresa.
En paralelo, la Secretaría de Comercio que conduce Augusto Costa analiza si la compañía no realizó también “publicidad engañosa” al ofertar planes que luego no otorgó. De comprobarse esa denuncia, otra batería de sanciones podría llegarle en los próximos días.
Las quejas en las redes sociales empezaron el mes pasado. Tanto en Twitter como en Facebook, muchos clientes de Movistar denunciaron no haber recibido ninguna notificación. También cuestionan que se hayan modificado los términos del contrato de manera unilateral.
La empresa argumenta que la información fue trasmitida a través de sus facturas y algunos SMS. “Vimos la necesidad de brindar una mejor experiencia de navegación, apuntando a que el cliente que requiere seguir navegando lo haga sin reducción de velocidad durante todo el mes“, argumentaron sus voceros días atras.
“Si hay un cambio en los planes, las empresas deben cumplir con las condiciones y obligaciones establecidas por el Estado nacional relativas a informar con antelación y claridad. Debemos realizar todo lo que sea necesario para proteger los derechos de los usuarios“, advirtió el secretario de Comunicaciones, Norberto Berner.

Aquellos usuarios que quieran solicitar más información o denunciar cambios en sus planes de telefonía celular pueden hacerlo a la Comisión Nacional de Comunicaciones (CNC) a través del teléfono 0800-333-3344 o a través de la página webwww.quenosecorte.gob.ar .
El Gobierno recordó además que, por el plan “Conocé lo que pagás”, las empresas de telefonía celular deben informar el costo de llamadas, SMS e internet 3G no sólo en sus facturas, sino también en sus respectivas webs, por mail, SMS o teléfono a todo aquel usuario que lo solicite.
