Un fiscal de Lomas de Zamora pidió hoy la pena de tres años y cuatro meses de prisión efectiva para un automovilista acusado de matar al músico Pablo José Gallo tras atropellarlo con su vehículo y dejarlo abandonarlo sin asistirlo, en junio de 2012, en la localidad bonaerense de Rafael Calzada, informaron fuentes judiciales.
Se trata del fiscal de juicio Jorge Luis Michelini, quien esta mañana pidió en su alegato ante el juez en lo Correccional 5 de Lomas de Zamora, Rubén Oscar Baca, que el imputado Ezequiel Penedo (27) sea condenado por el delito de “homicidio culposo agravado por conducción imprudente de un automotor”.
Michelini manifestó hoy en declaraciones a Télam que creía que debía “considerarse como un agravante de pena el haber mentido“, ya que a lo largo del juicio, comenzado el pasado 4 de mayo, Penedo “puso en práctica una estrategia montada para sacarlo del lugar del hecho“.
Es que para el fiscal quedó acreditado en el proceso que quiso hacer creer a las autoridades que había vendido su Renault 19 blanco antes del hecho -y que por ello debía acusarse al nuevo propietario del vehículo-, cuando en realidad la venta se realizó con posterioridad. Michelini también relató que varios testigos de la defensa que declararon durante el debate situaron falsamente a Penedo en otro lugar el día del hecho.
Finalmente, el fiscal consideró que “tiene que investigarse la actuación del personal de la Policía Científica de la provincia de Buenos Aires“, ya que pese a que familiares de Gallo (21) “preservaron la escena, en la que había vidrios, huellas, pedazos del vehículo, presentó un informe en el que decían que no había rastros“.
Una vez finalizada la presentación de Michelini, el juez Baca dispuso pasar a un cuarto intermedio y convocar nuevamente a las partes para el próximo 3 de agosto, cuando será el turno del alegato de la defensa.
El hecho ventilado en el juicio ocurrió alrededor de las 4.20 del 27 de junio de 2012, en el cruce de avenida San Martín y San Luis, en Rafael Calzada, partido de Almirante Brown, por donde Pablo regresaba en bicicleta de la casa de su primo.
De acuerdo con la acusación, cuando el ciclista cruzaba la avenida fue atropellado por un Renault 19 color blanco que iba a alta velocidad. Mientras que el conductor abandonó inmediatamente el lugar sin socorrerlo, Gallo falleció a los pocos minutos.
Tras varias movilizaciones y pedidos de Justicia, se presentaron testigos que aportaron datos a la investigación, junto al resultado de distintos peritajes y el análisis de las cámaras de seguridad, que permitieron identificar el auto involucrado primero y al acusado después.
Al momento de su muerte, Pablo tocaba el bajo en la banda “Elegantes Crotos”, era el menor de cuatro hermanos y había comenzado a estudiar junto a su madre para finalizar el colegio secundario.
