Los entes nacionales reguladores de la energía eléctrica y el gas (ENRE y ENARGAS) serán los encargados de dar la instrucción a las distribuidoras, luego de los fallos judiciales que suspendieron los aumentos dispuestos en los dos servicios públicos.
Los incrementos tarifarios en la electricidad comenzaron a regir en febrero y los del gas en abril, aunque en este último caso tuvieron sucesivas modificaciones que, al igual que las normas originales, fueron suspendidas por la Justicia por entender que no se cumplió con el requisito de convocar previamente a audiencias públicas, lo cual no fue considerado necesario por el gobierno.
Esa decisión, sin embargo, será parte de una estrategia que busca todo lo contrario. Mientras avanza lentamente con la puesta en marcha de los viejos cuadros tarifarios, el Gobierno espera que distintos pasos procesales y administrativos demoren su aplicación y le permitan ganar tiempo hasta que se expida la Corte Suprema, que tendrá la última palabra sobre las tarifas.
El fallo de la Corte Suprema, espera el Gobierno, podría ocurrir la semana próxima.
Por otra parte, el jefe de Gabinete, Marcos Peña, anunció el Ejecutivo apelará el fallo judicial que frenó el incremento dispuesto en las tarifas de electricidad, aseguró que se “va a plantear un per saltum a la Corte Suprema”, aunque advirtió que “tarde o temprano, lo que uno está gastando lo va a pagar”.
La intención oficial es encontrar un mecanismo que permita cumplir con los fallos de la Justicia que suspendieron los aumentos, pero al mismo tiempo no cierre la puerta a los futuros ajustes, que el Gobierno intentará implementar de todas maneras.
