Sobre el horario en que se llevará a cabo la ceremonia, el ministro coordinador indicó que el artículo 91º de la Constitución expresa que “la Presidenta cesa en el poder el mismo día que expira su período de cuatro años y no dice ninguna hora”, y añadió que “la vocación es hacerlo lo más temprano posible para poder desligar esta situación y que se continúe con la ceremonia, que sería el discurso que el nuevo presidente deberá prestar ante el Congreso Nacional”.
En sus declaraciones formuladas en la mañana del martes a la prensa en Casa de Gobierno, Fernández remarcó que Cristina “puede traspasar el mando entre las 8 de la mañana hasta las 11 de la noche porque cesa en el poder el mismo día en que expira el periodo de cuatro años”.
Añadió que se va ejecutar el traspaso de acuerdo al artículo 93, que dice que “tomarán posesión de sus cargos el presidente y el vice y prestarán juramento en manos del presidente del Senado de la Nación ante la Asamblea Legislativa”, y acotó que “como es un gobierno representativo, republicano y federal lo hace ante el Congreso porque es la forma de hacerlo ante el pueblo”
