La Corte Suprema de Justicia de Tucumán anuló el fallo de la Cámara en lo Contencioso administrativo y confirmó los resultados que consagraron como futuro gobernador al candidato del FpV, Juan Manzur, quien se impuso por 12 puntos de diferencia sobre el postulante del Acuerdo para el Bicentenario, José Cano.
El fallo, que se dictó por unanimidad, se conoció pasada la medianoche y fue tomado por el alto tribunal que estuvo constituido por los vocales naturales René Goane y Daniel Posse, y los camaristas civiles que fueron elegidos por sorteo, Carlos Ibáñez, Benjamín Moisá y Raúl Bejas.
El fallo de la Corte deja sin efecto la decisión de los camaristas de la Sala I de la Cámara Contencioso Administrativa Salvador Ruiz y Ebe López Piossek, quienes el 16 de septiembre anularon los comicios del 23 de agosto y ordenaron al Poder Ejecutivo que llame a nuevas elecciones, una sentencia sin precedentes a nivel local y nacional.
El gobierno y el Partido Justicialista apelaron el fallo ante la Corte Suprema local, solicitaron el “per saltum” para agilizar los trámites y 48 horas después se conoció la resolución judicial que revoca la resolución de la Cámara y ratifica el triunfo de Manzur.
La Corte, con el voto favorable de tres de sus miembros, también decidió levantar la cautelar que le impedía a la Junta Electoral Provincial proclamar a los ganadores, según le informó a Télam el apoderado del Frente para la Victoria, Marcelo Caponio.
El fallo de la Corte de Tucumán aún puede ser recurrido y los abogados del Acuerdo para el Bicentenario anticiparon que presentarán el recurso extraordinario para que el caso llegue ante la Corte Suprema de Justicia de la Nación.
Si esta vía fracasa -el alto tribunal local debe habilitarla-, la oposición aún tiene la posibilidad de intentar un recurso de queja, por extraordinario denegado, directamente ante la Corte nacional.
Ese estrado puede, a su vez, rechazar el juicio o admitirlo y pronunciarse en un plazo indefinido de tiempo, lo que podría generar la intervención federal de la provincia si el caso no tiene una resolución final antes del 28 de octubre, fecha en la que finalizan los mandatos de las autoridades del Poder Ejecutivo y de los legisladores.
El gobernador José Alperovich advirtió que si deben llamar a nuevas elecciones se necesitan entre cuatro y seis meses por lo que resulta imposible definir por esa vía las futuras autoridades provinciales antes de la fecha prevista para el final de su mandato.
Tucumán no cuenta con una Ley de Acefalía que pueda solucionar ese problema, aunque legisladores opositores presentarán en las próximas horas un proyecto para subsanar ese problema y evitar que la solución llegue por la vía de la intervención federal.
El proyecto contempla la posibilidad de prorrogar los mandatos del gobernador y vice, legisladores, intendentes, concejales y delegados comunales hasta que la causa se resuelva definitivamente en la Justicia.
