Un hombre condenado a 18 años de prisión por el homicidio simple de su ex pareja logró ahora la libertad tras una polémica medida judicial que le permitió salir libre a Roberto Almirón, de 53 años, condenado a 18 años de cárcel por la muerte de Ivana Correa, ocurrida en el 2011 en Esteban Echeverría. Así lo decidió la Cámara de Apelaciones de Lomas de Zamora.
A Roberto Almirón, el Tribunal Oral en lo Criminal (TOC) 4 de Lomas de Zamora, por decisión unánime, lo condenó a 18 años de prisión por el “homicidio simple” de su ex pareja Ivana Correa, a quien le arrojó alcohol y quemó, provocándole la muerte. El Tribunal de Casación bonaerense confirmó el fallo y ordenó su detención, sin embargo a los pocos días la Cámara de Apelaciones de Lomas de Zamora lo dejó en libertad.
El abogado de la familia Correa, Gabriel Ponce explicó que Almirón estuvo preso alrededor de 15 días, luego de que Casación bonaerense
confirmara la condena a fines del mes pasado. El hombre permanecía en libertad hasta ese momento a pesar de haber sido condenado a 18 años de prisión por un tribunal de Lomas de Zamora el año pasado.
Tras la decisión de Casación, el tribunal ordenó la detención de Almirón, de 53 años. Su defensa presentó un hábeas corpus y la sala III de la Cámara de Apelaciones y Garantías de Lomas le hizo lugar y lo volvió a dejar en libertad.
“La Cámara de Apelaciones de Lomas lo libera, argumentando que no hay peligro procesal de que se fugue porque siempre que se lo convocó se presentó, también sostuvo que la defensa presentó una apelación ante Suprema Corte por el fallo condenatorio que confirmó Casación”, indicó el letrado.
Ponce explicó que “es un fallo inusual, inédito porque la Corte Suprema establece que una vez que se confirma una condena, queda firme. Es lo que se llama doble instancia. Acá no se respetó ese principio”.
“Hay personas que están con prisión preventiva sólo acusados de delitos cuya pena no supera los 8 años. En el caso de Almirón hablamos de 18 años de prisión por un homicidio”, explicó.
