La semana pasada los jueces del Tribunal de Lomas de Zamora determinaron una pena de tres años y cuatro meses de prisión Ezequiel Penedo (27) por atropellar y matar a Pablo Gallo, un joven músico que durante la madrugada del 27 de junio de 2012 circulaba en su bicicleta por Rafael Calzada cuando fue embestido por un auto que iba a gran velocidad.
Pero a través de un recurso de Habeas Corpus presentado por su abogado defensor, Penedo fue puesto en libertad. La Sala 3 de la Cámara Penal de Apelación y Garantías hizo lugar al pedido del letrado y resolvió “hacer lugar a la acción de habeas corpus y dejar sin efecto la detención dispuesta por el titular del Juzgado de Garantías Nº 5 (el juez Rubén Oscar Baca) respecto de Ezequiel Penedo y ordenar su inmediata libertad”.
Según indicaron fuentes judiciales a este medio, el Juzgado Correcional Nº 5 notificará al fiscal Jorge Michelini, quien “seguramente se expedirá” ante la medida y la apelará.
Desde ese momento, correrán 20 días para que los magistrados aprueben el pedido y se le revoque la libertad a Penedo. En caso de que eso no ocurra, Michelini podría recurrir a la Cámara de Casación Penal, iniciando de esa manera una segunda instancia judicial, la cual requiere de plazos temporales muchos más amplios, lo que podría darle más tiempo en libertad al condenado.
Está decisión causo desazón en la familia de la victima que se bien hubiera querido una pena más larga esta “tranquila” porque el culpable iba a ir preso.
En los momentos del conocerse el fallo, la madre de Pablo, María Cristina Vega, había asegurado que quedó conforme con el fallo ya que en la mayoría de los casos, cuando se trata de accidentes en la vía pública, el culpable queda libre: “Estoy Tranquila. A pesar de que no era la pena que yo hubiese querido irá preso”.
Sin embargo, cinco días después de la sentencia, las palabras de María hoy son distintas: “Hace más de tres años que trabajamos para la sentencia del miércoles y enterarnos de esto fue terrible”, expresó la mujer en diálogo con el diario Info Región. “Esperemos que el fiscal apele el recurso y que (Penedo) vuelva tras las rejas”, sentenció.
El suceso
El hecho ventilado en el juicio ocurrió alrededor de las 4.20 del 27 de junio de 2012, en el cruce de avenida San Martín y San Luis, en Rafael Calzada, partido de Almirante Brown, por donde Pablo regresaba en bicicleta de la casa de su primo.
De acuerdo con la acusación, cuando el ciclista cruzaba la avenida fue atropellado por un Renault 19 color blanco que iba a alta velocidad. Mientras que el conductor abandonó inmediatamente el lugar sin socorrerlo, Gallo falleció a los pocos minutos.
Tras varias movilizaciones y pedidos de Justicia, se presentaron testigos que aportaron datos a la investigación, junto al resultado de distintos peritajes y el análisis de las cámaras de seguridad, que permitieron identificar el auto involucrado primero y al acusado después.
