El juez federal Alberto Santamarina dispuso la detención de un guarda de la formación de la línea Roca, Adrián Maure, quien fue apuntado por el maquinista y su ayudante, quienes habían sido apresados el lunes y liberados esta noche, en el marco de la causa del choque de trenes de Temperley que provocó decenas de heridos el domingo por la noche.
De las declaraciones de ambos detenidos, imputados por los delitos de estrago doloso y daño agravado por el juez de Lomas de Zamora Sergio Mola, también se desprende que reconocieron que intercambiaron funciones, tal como se observó en un video.
A su vez, fuentes judiciales aseguran que los acusados dijeron no haber escuchado los pedidos de detener la formación y que salieron de la estación por orden del guarda.
Los dos acusados reconocieron que el ayudante Navarro manejó la formación a pesar de que no tenía licencia de la CNRT para hacerlo.
La Comisión Nacional Reguladora del Transporte (CNRT) es la autoridad encargada de emitir la licencia que habilita a un motorman a conducir un tren. Los ayudantes no tienen carnet y está prohibido que tomen el control de la máquina.
Según sus declaraciones, Navarro iba a manejar sólo hasta la siguiente estación de Mármol y confirmaron que en los tramos anteriores el motorman Sánchez estuvo al frente de los comandos. Ambos admitieron que no era la primera vez que manejaba el ayudante y aseguraron que el convenio colectivo de trabajo establece que puede hacerlo en caso de extrema necesidad.
Los acusados dijeron que la única forma que tienen los ayudantes de practicar es durante los trayectos para tener conocimientos y poder reemplazar al maquinista durante un viaje.
Los trabajadores ferroviarios declararon que la noche del domingo salieron de la estación de Temperley porque el guarda les dio la seña y la contraseña para iniciar el recorrido a las 21.30 como estaba previsto y resaltaron que durante el trayecto no escucharon los pedidos de detenerse del comando central: “Parate 2277” y “Parate 77”.
Asimismo, señalaron que la vía estaba preparada para salir porque, de no haber estado habilitados para hacerlo, automáticamente la propia vía los deriva a un paragolpes que impide que el tren continúe.
